These Terms & Conditions (“Terms”) govern your use of the proptye website. Please read them carefully together with our Privacy Policy.

1. Introduction and acceptance of terms

proptye (“proptye”, “we”, “us” or “our”) operates an online property listing and information platform. By visiting the website, creating an account, posting a property or sending an enquiry, you agree to these Terms. If you do not agree, please do not use the website.

You must be at least 18 years old and able to enter into a legally binding agreement to register an account, post a property or make an enquiry.

2. Our role as a property listing platform

proptye provides a place where property owners, agents, builders and developers (“listers”) can advertise properties, and where buyers, tenants and investors can find them. Unless clearly stated otherwise on a particular listing:

  • proptye does not own, sell, rent or lease the properties listed on the website.
  • proptye is not a party to any agreement, negotiation or transaction between users and listers.
  • proptye does not act as the legal representative, broker or agent of any buyer, seller, landlord or tenant.
  • Listings are provided by listers. A review or “verified” label means only that our team carried out basic checks on the listing at the time; it is not a guarantee of ownership, title, approvals, condition, price or availability.

3. Website usage rules

You agree to use the website only for lawful purposes related to finding, listing or enquiring about property. You must not:

  • Use the website in a way that breaks any law or regulation.
  • Interfere with the website’s working, security or other users’ use of it.
  • Copy, collect or extract listings, contact details or other content in bulk (for example, by scraping, bots or automated tools) without our written permission.
  • Use contact details found on the website for spam, unrelated marketing or harassment.

4. User registration and account responsibilities

  • You must give accurate, current and complete information when you register and keep it up to date.
  • You must verify your e-mail address with the one-time password (OTP) we send before your account becomes active.
  • You are responsible for keeping your password secret and for all activity under your account.
  • Tell us immediately if you believe your account has been used without your permission.
  • Create only one account for yourself, and do not create accounts for other people without their permission.

5. Property listing and submission rules

If you post a property, you confirm that:

  • You are the owner of the property, or you are authorised by the owner to advertise it.
  • The property is genuinely available for sale or rent on the terms you describe.
  • All information, prices, photos, videos and documents you provide are true, accurate, current and not misleading.
  • You have the right to use and publish all photos, videos and other material you upload.
  • The listing complies with all applicable laws, including real-estate regulations (such as RERA registration requirements where they apply) and advertising rules.

Listings are reviewed before publication. We may edit, refuse, unpublish or remove any listing at our discretion – for example, if it appears duplicate, inaccurate, outdated, misleading or in breach of these Terms. You must update or remove your listing promptly when the property is sold or rented, or when any details change.

6. Property information accuracy

Property details on the website are provided mainly by listers and may also come from public sources. While we try to keep the website useful and up to date, property information – including prices, availability, area, specifications, amenities, nearby facilities, images, floor plans, possession dates and approvals – may change at any time, may be incomplete, and may contain errors.

Always confirm all property information independently before making any decision. We strongly recommend that you visit the property, check the title and ownership documents, verify approvals and registrations with the relevant authorities, and take independent legal and financial advice before paying any money or signing any agreement.

7. Property prices and availability disclaimer

Property prices shown on this website are indicative and may vary depending on the property, location, size, specifications, availability, market conditions and other applicable factors. The final price may differ from the price displayed online and may be subject to taxes, charges and fees that are not shown. Please contact the property owner, agent or developer to confirm the latest price and availability.

8. No guarantee of property information, ownership, availability or pricing

proptye does not guarantee, warrant or endorse:

  • The ownership, title or legal status of any property.
  • The accuracy or completeness of any listing, price, image or description.
  • That any property is available, or will remain available, for sale or rent.
  • The quality, condition, construction progress, possession date or approvals of any property or project.
  • The identity, conduct or reliability of any lister or user.

9. User-generated content

Listings, photos, descriptions, messages and other material you submit are your “content”. You remain responsible for your content. By submitting it, you give proptye a non-exclusive, royalty-free, worldwide permission to host, store, display, reproduce, format (for example, resize or watermark images) and publish it on the website and in related promotion of the listing, for as long as it is on the website.

You must not submit content that is false, misleading, defamatory, obscene, discriminatory, or that infringes anyone else’s copyright, trademark, privacy or other rights.

10. Communication between users and owners or agents

When you call, WhatsApp, e-mail or send an enquiry to a lister through the website, your contact details and message are shared with that lister and with our team. Any communication, negotiation, site visit or meeting that follows takes place directly between you and the lister. Please take normal safety precautions – meet in safe places, do not share sensitive financial information, and be careful with anyone who asks for advance payments before you have verified the property and the person.

11. Enquiries and transactions

  • Any agreement to buy, sell, rent or lease a property is made only between you and the other party. proptye is not a party to it.
  • Any token money, booking amount, deposit, rent, brokerage or other payment is made at your own risk and directly between you and the other party.
  • You are responsible for checking documents, approvals, title and all terms before entering into any transaction.
  • proptye is not responsible for any dispute between users and listers, but we may, at our discretion, remove listings or accounts involved in a complaint.

12. Prohibited activities

You must not:

  • Post fake, duplicate, misleading or unavailable properties, or false prices.
  • Pretend to be another person, company, owner or agent, or misrepresent your relationship with a property.
  • Post content that infringes copyrights or trademarks (for example, photos taken from other websites without permission).
  • Send spam, unsolicited marketing or abusive messages to other users or listers.
  • Upload viruses or harmful code, or try to hack, overload or gain unauthorised access to the website or other accounts.
  • Collect or harvest personal information of other users.
  • Use the website for any fraudulent, illegal or misleading purpose.

13. Intellectual property and website content

The website design, logo, brand name, layout, text, graphics, software and other material created by proptye are owned by or licensed to proptye and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, republish, distribute or create derivative works from the website or its content without our prior written permission. Content provided by listers belongs to them or their licensors.

14. Third-party websites and services

The website may contain links to, or features provided by, third parties – such as maps, WhatsApp, video platforms, social media, banks, builders’ websites or loan providers. We do not control and are not responsible for their content, products, services or privacy practices. Your use of third-party websites and services is at your own risk and subject to their terms.

15. Limitation of liability

The website and all information on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law:

  • proptye makes no warranties of any kind about the website, its content or any listing.
  • proptye is not liable for any loss or damage – including financial loss, loss of opportunity, or indirect or consequential loss – arising from your use of the website, your reliance on any listing or information, any transaction or dispute with a lister or user, or any interruption, error or unavailability of the website.
  • We do not guarantee that the website will always be available, secure or free from errors or viruses.

Nothing in these Terms limits any liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless proptye, its team and partners from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your content, your listings, your use of the website, your dealings with other users or listers, or your breach of these Terms or any law.

17. Account suspension and termination

We may suspend, restrict or close your account, and remove your listings or content, at any time and without prior notice if we believe you have broken these Terms, provided false information, posted fake or misleading listings, misused the website, or if required by law. You may close your account at any time by contacting us. Sections that by their nature should continue (such as disclaimers, limitation of liability and indemnification) will continue to apply after your account is closed.

18. Changes to these Terms

We may update these Terms from time to time. The updated version will be published on this page with a new “last updated” date. Continuing to use the website after a change means you accept the updated Terms. If you do not agree with a change, please stop using the website.

19. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising from or related to these Terms or the website will be subject to the exclusive jurisdiction of the competent courts in India at the place where proptye has its registered office.
